Trademark Registration in Nigeria: A Practical Guide for Businesses
Get in touch on Whatsapp now:

Trademark registration in Nigeria is essential for any business that wants to protect its brand, expand into new markets, and prevent unauthorized use of its identity. Whether you’re an importer, wholesaler, exporter, manufacturer, or distributor, securing your trademark provides long-term commercial security—especially in Nigeria’s competitive FMCG and retail sectors.

Why Trademark Registration Matters in Nigeria

A registered trademark gives your business exclusive rights to use your brand name, logo, slogan, or product identity. This protects you from imitation products, brand misuse, and reputation damage—problems commonly seen in busy trading hubs across West Africa.

For companies entering the Nigerian market or distributing across the region, trademark registration is also a requirement for many corporate contracts, product certifications, and international partnerships.

If your brand is part of your competitive edge, registration isn’t optional—it’s strategic.

The Trademark Registration Process in Nigeria

Trademark applications in Nigeria are handled by the Trademarks, Patents and Designs Registry, under the Ministry of Industry, Trade & Investment.

The process includes:

1. Trademark Search

Before filing, you must check whether a similar or identical mark already exists.
A proper search reduces the risk of rejection and ensures your brand is legally protectable.

Wigmore Trading can assist with early-stage trademark checks as part of our market-entry support services.

2. Filing the Application

After confirming availability, an application is submitted with details of the proprietor, a representation of the mark, and the relevant product or service class under the Nice Classification system.

3. Acknowledgement & Acceptance

Once filed, the Registry issues an Acknowledgement Letter, followed by an Acceptance Letter if the mark passes initial review. At this stage, your trademark is considered accepted but not yet fully registered.

4. Publication in the Trademark Journal

The accepted trademark is then published in the official journal for opposition. If no objections are raised within the allowed timeframe, the process continues smoothly.

5. Issuance of Certificate

After the publication phase, the Registry issues the Trademark Registration Certificate.
This certificate provides full legal protection for an initial period of seven years and can be renewed indefinitely every 14 years.

How Long Does Trademark Registration Take?

In practice, trademark registration in Nigeria may take several months. Early searches and correctly prepared filings help avoid delays. Businesses expanding product lines or entering new Nigerian markets should start the process early.

Common Challenges and How to Avoid Them

Trademark applicants often encounter issues such as incomplete documentation, filing errors, and similarity conflicts with existing marks. These delays can impact product launches, distribution contracts, and regulatory approvals.

Wigmore Trading supports businesses entering the Nigerian market with reliable trade facilitation, sourcing, and compliance guidance—helping you avoid costly mistakes as you grow.
